WARRANTY
Total Fence Inc. warrants that for a period of (2) years from the date of installation the goods supplied pursuant to this agreement shall be free from defects in workmanship and material. This limited warranty only covers materials provided by and installed by Total Fence, Inc. erectors and does not cover material installed, altered or adjusted by anyone other than Total Fence Inc. erectors.
Under this warranty the buyer agrees that is sole and exclusive remedy against Total Fence, Inc. shall be limited to repair or replacement of any defective goods sold pursuant to this agreement, for a period of (2) years from the date of original date of installation, provided by Total Fence, Inc., is promptly notified in writing of any such defect. This exclusive remedy shall not be deemed to have failed of its essential purpose so long as Total Fence, Inc. is willing and able to repair or replace the defective goods.
THIS WARRANTY IS IN LIEU OF ALL OTHER WARRANTIES, EXPRESSED OR IMPLIED, INCLUDING WITHOUT LIMITATION ANY WARRANTIES OR MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE, SAID WARRANTIES BEING EXPRESSLY DISCLAIMED.
TOTAL FENCE, INC. SHALL NOT BE HELD LIABLE FOR ANY SPECIAL OR CONSEQUENTIAL DAMAGES OR FOR LOSS, DAMAGE, OR EXPENSE (WHETHER OR NOT CAUSED BY OR RESULTING FROM TOTAL FENCE, INC. NEGLIGENCE) DIRECTLY OR INDIRECTLY ARISING FROM USE OF THE EQUIPMENT SOLD HEREUNDER OR ARISING FROM ANY OTHER CAUSE.
